These Terms of Service ("Terms") govern your access to and use of the filter8() content-filtering API and related websites, dashboards, and documentation (collectively, the "Service"), operated by Filter8 ("Filter8", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of an organization, you represent that you are authorized to bind that organization.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. We may make the Service available under a separate written agreement; where such an agreement conflicts with these Terms, the written agreement controls.

2. The Service

Filter8 provides a deterministic text content-filtering API that returns a verdict (allow, mask, reject, or review) for submitted text, along with optional classifiers, explain traces, and a stateful conversation layer. The Service is provided as a managed, hosted API.

Filter8 is a tool that assists with content moderation. It does not guarantee the detection of all objectionable content, nor the absence of false positives. You remain responsible for your own moderation decisions and for compliance with laws applicable to your platform and users.

3. Accounts & API Keys

You must provide accurate account information and keep it current. You are responsible for all activity under your account and API keys, and for maintaining the confidentiality of your keys. A key secret is shown once at creation and stored by us only as a hash; you are responsible for storing it securely.

Notify us promptly at [email protected] of any unauthorized use of your account or keys. You may not share, resell, or sublicense keys except as permitted by your plan. We may rotate or revoke keys where we reasonably believe they have been compromised.

4. Acceptable Use

You agree not to use the Service to: (a) violate any law or the rights of others; (b) attempt to reverse-engineer, extract, or reconstruct our dictionaries, models, or non-public methods except to the extent permitted by law; (c) circumvent rate limits, quotas, or usage metering; (d) submit content you are not legally permitted to process; or (e) use the Service to build a competing content-filtering product.

You are responsible for obtaining any consents required to submit end-user content to the Service, and for handling verdicts in a manner consistent with applicable law, including with respect to minors.

5. Customer Data

"Customer Data" is text and related data you submit to the Service. As between the parties, you retain all rights in Customer Data. You grant Filter8 a limited license to process Customer Data solely to provide and maintain the Service.

The core filter is stateless and retains no submitted text after responding. Where you enable the conversation layer, a limited window of Customer Data is retained subject to the Privacy Policy, encrypted at rest, with per-rating retention caps and an erasure API. We may process de-identified, aggregated operational metrics to improve the Service.

6. Fees & Billing

Paid plans are billed in advance on a recurring basis per the then-current pricing. Usage above an included quota is billed as overage at your plan's rate, or throttled, per your key configuration. Fees are non-refundable except as required by law or expressly stated.

We may change pricing on prospective notice; changes take effect at your next billing cycle. Taxes are your responsibility unless we are legally required to collect them. Failure to pay may result in suspension.

7. Availability & Support

We aim for high availability and publish status at our status page. Service-level commitments, where offered, are stated in your plan or a separate SLA. We may perform maintenance and may modify, suspend, or discontinue features with reasonable notice where practicable.

8. Intellectual Property

The Service, including its software, dictionaries, models, documentation, and the filter8() name and marks, is owned by Filter8 and its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a non-exclusive, non-transferable right to access and use the Service during your subscription. No rights are granted except as expressly stated.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FILTER8 DOES NOT WARRANT THAT THE SERVICE WILL DETECT ALL OBJECTIONABLE CONTENT, BE ERROR-FREE, OR BE UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILTER8 WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS OR DATA. FILTER8'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO FILTER8 IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Term & Termination

These Terms apply while you use the Service. You may cancel at any time from your dashboard. We may suspend or terminate access for material breach, non-payment, or misuse. Upon termination, your right to use the Service ends and we will handle Customer Data per the Privacy Policy. Sections that by their nature should survive termination will survive.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, provide reasonable notice. Your continued use after changes take effect constitutes acceptance.
